What the Texas DWI Surcharge Costs You

Effective September 1, 2008, Texas State law requires all persons convicted of Texas DWI to pay a surcharge to the Texas Department of Public Safety (TDPS). This surcharge must be paid for three years after the date of conviction. The amounts of surcharge are:

$1,000 per year — DWI First offense

$1,500 per year — DWI Second or more offense

$2,000 per year — DWI with alcohol concentration of 0.16

How Your Pay the Texas DWI Surcharge

If convicted the TDPS will contact you by mail at the address on your drivers license to inform you of the charge. It can be paid in a lump sum or with a finance charge, payable in monthly installments.

At this time there is no way to avoid the surcharge. The 2011 Texas Legislature is revisiting this statute during this term and it may be changed. It is unclear as to what may be done or whether it will be applied to convictions that occurred prior to the enactment of any new law on the topic.
