Expunction Cleans Your Criminal Record

Expunction is a unique legal process that results in the destruction of criminal records. If you are entitled to expunction of a criminal record, all records of your stop, arrest, confinement, and prosecution are gathered and destroyed. Additionally the Texas Department of Public Safety acting for itself and the Federal Bureau of Investigations (FBI) are also ordered to destroy any records of the event. As a result, if your case has been expunged, there should be no way to find it either on paper or on the Internet. Expunction cleans your record.

Expunction and Records Outside the U.S.

Be advised however that some criminal search engines are located outside of the United States and not subject to this Order of the Court. Not often, but sometimes records that have been expunged may be found on the Internet by a sophisticated user.

An Unfair Filing Fee for Expunction?

As unfair as it may seem, the State requires you to pay a filing fee for a Petition for Expunction. Currently the filing fees range from $225.00-250.00 and must be paid at the time of the filing of the Petition. This is not an attorney fee, rather it is a fee levied by the State for the presentation of this lawsuit in court.

Do You Qualify for Expunction?

Expunction was designed to protect the wrongfully accused. As such, only people whose cases have been won at trial, or dismissed for lack of probable cause qualify to request an expunction.

If you were granted deferred adjudication, you may not apply for expunction. You may however qualify for a Motion for Non-Disclosure. This prevents everyone except law enforcement from accessing these records.
