The newest scientific tool being used in DWI cases is the SCRAM ankle bracelet. SCRAM stands for Secure, Continuous, Remote Alcohol Monitor. As the name suggests, this is a device that must be worn 24/7. It is designed to measure alcohol in your perspiration or sweat.
It can be ordered as a condition of your release from jail or as a condition of probation if granted. Please note that this device is not ordinarily ordered in DWI First or DWI Second offenses. It is generally reserved for DWI Third or more offenders. It is also substituted for the deep lung device if the arrested person does not have a car to drive while out on bond in DWI First and DWI Second cases.
Alcohol is eliminated from the human body through sweat, breath and urine. This device has a detector next to your your skin and analyzes any alcohol that may be contained in your sweat.
The program is continuously monitored 24/7 to alert the Court of any consumption of alcohol by the offender. Any alcohol is measured and recorded and reported to the Court.
Sometimes the report may take several days to reach the Court. Typically upon receipt of the report, the Court will hold the offenders bond insufficient to protect the public. The Court generally notifies the Attorney of Record of the infraction so that the defendant can be brought to Court to explain the alcohol. Depending on the results of this hearing the defendant may be continued on bond or immediately jailed until the conclusion of his case.
The device is an ankle bracelet, of fairly cumbersome design. It does fit under most pants, but of course will show if you are wearing a skirt or short pants. It is waterproof so that it can be worn during a bath, a shower or swimming.
If a SCRAM device is ordered in your case you must realize the Court is paying particularly close attention to your conduct during your case. Any consumption of alcohol is reported. This applies to cough syrups and food marinated in alcohol. You must be very careful to avoid alcohol while on this device.
