What Your Second DWI Arrest Means to You

Texas law says if you have ever had a prior DWI conviction, even decades ago, it can be used to enhance the penalty you face for a second DWI arrest. The time between the first and second is important.

If your first DWI was 5 years or less, you faced enhanced penalties. If it is over 5 years, penalties are still more than a DWI First, but not as severe.

There Could Be Jail Time

If you are convicted of a DWI Second, you will be required to serve time in jail as a condition of any probation granted. This cannot be avoided. Typically the jail sentence is between 3-7 days in jail. Depending on the facts of your case (such as collision, bad driving, bad attitude) this range can be increased.

There Could Be a DLD

As a condition of your release from jail, you will be required to install a deep lung device in your car. This device requires you to blow into a unit to measure the alcohol concentration in your breath. If your concentration is 0.030 or more, your car will not start until your concentration has fallen below that limit. Additionally, you are required to blow into the device every twenty minutes that you are driving to make sure you are not drinking and driving.

It is important that you understand this device measures your alcohol concentration and every time you start your car. Any failures or an extremely low number of starts are reported to the courts and you will be required to explain your conduct for the infractions. Many times no punishment is given. In other occasions, a day in jail or revocation of your bond may occur.
